PA DUI LAWS

The PA DUI laws are designed to punish motorists who drive, operate or physically control motor vehicles on roads or traffic ways in Pennsylvania while drunk or impaired.  The punishment increases the “drunker” the motorist is.  The punishment also is impacted by how many prior DUI convictions the motorist has.   Generally speaking, the drunker you are and the more DUI’s you have in your past, the stiffer the punishment.

The police often determine how drunk a motorist is by testing the motorist’s breath or blood.  The police are looking for the motorist’s Blood Alcohol Concentration (BAC).  The PA DUI Laws make it illegal to drive, operate or be in physical control of a motor vehicle when the motorist BAC is above a .08%.   It is also illegal to for a motorist to drive with drugs (including marijuana) or a combination of drugs and alcohol in his or her system.  Finally, if a motorist refuses to submit to a breath or blood test for DUI testing, the PA DUI Laws treat that person as if they would have submitted a sample containing twice the legal limit of alcohol (.16%)
